H4 EAD Final Rule

 Employment Authorization for Certain H-4 Dependent Spouses - Final Rule

This final rule amends Department of Homeland Security (“DHS” or “Department”) regulations by extending eligibility for employment authorization to certain H-4 dependent spouses of H-1B nonimmigrants who are seeking employment-based lawful permanent resident (“LPR”) status. Such H-1B nonimmigrants must be the principal beneficiaries of an approved Immigrant Petition for Alien Worker (Form I-140), or have been granted H-1B status in the United States under the American Competitiveness in the Twenty-first Century Act of 2000, as amended by the 21st Century Department of Justice Appropriations Authorization Act. DHS anticipates that this regulatory change will reduce personal and economic burdens faced by H-1B nonimmigrants and eligible H-4 dependent spouses during the transition from nonimmigrant to LPR status. The final rule will also support the goals of attracting and retaining highly skilled foreign workers and minimizing the disruption to U.S. businesses resulting from H-1B nonimmigrants who choose not to pursue LPR status in the United States. By providing the possibility of employment authorization to certain H-4 dependent spouses, the rule will ameliorate certain disincentives for talented H-1B nonimmigrants to permanently remain in the United States and continue contributing to the U.S. economy as LPRs. This is an important goal considering the contributions such individuals make to entrepreneurship and research and development, which are highly correlated with overall economic growth and job creation. The rule also will bring U.S. immigration policies concerning this class of highly skilled workers more in line with those of other countries that are also competing to attract and retain similar highly skilled workers.

Proud Victory on H4 Visa Work Authorization

San Francisco – March 23, 2015 – The Shah Peerally Law Group PC, congratulates all the H4 visa holders who will benefit from a work permit (also know as the EAD).  Shah Peerally, President of the law group, has extensively fought and lobbied for this amendment on the existing H1B regulations.  On May 26, 2015 certain H4 visa holders will actually be able to file for an employment authorization (EAD).

The H4 EAD or work permit is a long awaited relief to thousands of H4 visa holders especially those from countries such as India and China where the waiting time for a permanent residence sometimes exceeds 10 years.  This work permit will surely be very much welcome by all.

The H4 Visas' Curse

President Obama in his remarks in El Paso last May said, "In recent years, a full 25 percent of high-tech startups in the United States were founded by immigrants, leading to more than 200,000 jobs in America." This was echoed, in the President's Council on Jobs and Competitiveness, which stated in its report, "Highly skilled immigrants create jobs, they do not take jobs." More recently, In a State of the Union address, President Obama again observed that "Innovation is what America has always been about. Most new jobs are created in start-ups and small businesses."
Do such statement sound hollow in the face of what is increasingly becoming one of the biggest potential dangers to American economy, the lack of growth in different sectors fueled by in house talent. When president Obama talks about 'contributing to the nation and about partnering in crises, isn't he forgetting about tapping the huge latent talent that the US is practically sitting on?

Immigration lawyer Shah Peerally is a very happy immigration lawyer today. His firm has fought for the H-4 EAD for several years and this week the firm received the news that some H4 Visa holders will receive work permits.
Although President Obama announced his moves regarding immigration in November, the movement towards achieving the reforms has been pushed by attorney Peerally and a small group of dedicated individuals for some years. The reform is aimed at skilled immigrants. Currently the holders of H-4 visas are unable to earn income or hold a social security number. It is usually used by spouses of those holding the H-1B visa and some others.
